Przedmiotem niniejszego opracowania jest analiza wybranych zagadnień dotyczących zarządu nieruchomością zajętą w toku postępowania egzekucyjnego. Szczególną uwagę poświęcono tutaj zagadnieniu zbycia nieruchomości w trakcie postępowania egzekucyjnego i jego skutkom w zakresie sprawowania zarządu. Autorka zwróciła uwagę na pewne wątpliwości interpretacyjne dotyczące niektórych przepisów regulujących tą materię. Wskazała także na problemy, jakie mogą zaistnieć w sytuacji, gdy po zbyciu nieruchomości w toku egzekucji, jej nabywca stanie się dłużnikiem, przeciwko któremu prowadzone jest postępowanie egzekucyjne w stosunku do tej nieruchomości. Ze względu na fakt, że przepisy dotyczące zarządu zajętą nieruchomością nie precyzują jednoznacznie, kto w takiej sytuacji powinien sprawować zarząd nieruchomością, autorka podjęła próbę analizy tego zagadnienia i wskazała jej zdaniem najbardziej racjonalny sposób interpretacji tych przepisów, zaznaczając jednak konieczność ich doprecyzowania przez ustawodawcę.
Streszczenie (j. angielski)
The subject of this study is the analysis of selected issues concerning the management of the real estate occupied during the enforcement proceedings. Particular attention is paid here to the issue of the sale of real estate during the enforcement proceedings and its effects in the area of management. The author drew attention to some interpretation doubts regarding some of the provisions regulating this matter. She also pointed to problems that may arise in a situation where after the sale of the property during the execution, the buyer becomes a debtor against whom enforcement proceedings are conducted in relation to this property. Due to the fact that the regulations concerning the management of the occupied property do not clearly specify who should manage the real estate in such a situation, the author has attempted to analyze this issue and indicated in its opinion the most rational way of interpreting these provisions, however, indicating the need for further clarification by the legislator.
