W ostatnich latach pojawiły się koncepcje kary jako komunikatu dla społeczeństwa oraz sprawcy. Postrzegana w ten sposób kara jest pewnego rodzaju symbolem, komunikatem mającym na celu doprowadzenie do potępienia sprawcy, wskazania wartości zasługujących na ochronę oraz poinformowania, iż wyrządzona krzywda stanowi dla społeczeństwa zło zasługujące na karę. Celem mojego wywodu będzie zaprezentowanie koncepcji komunikacyjnej kary w ujęciu prof. Antony’ego Duff’a, a także analiza krytyki tej koncepcji.

Over the past few years the concept of a punishment as a communication beetwen the society and the offender becomes more and more popular. From this perspective, a punishment is a symbol, some sort of a message which aim is to condemn the offender, to indicate the values which deserve a protection and to inform the society that harm, which has been caused, is wrong to the society and deserves a punishment. The purpose of my argument is to present the concept of a punishment as a communication in the view presented by professor Antony Duff and to analyse this concept’s criticism.
